Delay claims are usually fought in shades of gray: competing schedule analyses and exhausting arguments among the owner, its consultants and the contractors. Vanguard Resolve moves these disputes to black and white, based on the record.
Every change, every year.
We identify changes in schedule statements, forensically test the schedule record, and look for double-dipping, the same delay or cost claimed more than once. We go back years to validate claims.
No claim is final.
Prior approvals are not the end of the story. If the record does not support a claim, amounts previously approved or paid can be revisited, subject to the contract and the law. A contractor that submits false or inflated claims may face False Claims Act liability.
Ab initio methodology.
We test each claim from the beginning of the record, not from the contractor’s narrative. We examine the claimant’s own conduct (late notice, working without reservation of rights, accepting payment) for waiver and equitable estoppel, defenses that can defeat or reduce a claim. Knowingly false claims can carry civil and, in serious cases, criminal consequences.
